03. International divorce
International family law? A different ballgame altogether
A ‘regular’ divorce is often complicated enough. Add international elements, and things quickly become far more complex. The tangle of treaties, EU regulations and national laws in international family law makes it nearly impossible to determine the applicable rules without expert help.
A marriage has international aspects if:
- You and your partner have different nationalities and were married abroad
- You married in the Netherlands but moved abroad
- One of you lives in the Netherlands and the other lives in a different country
Dutch law or foreign law?
In international divorces, one of the first questions is: which court has jurisdiction to rule on your divorce? Next, we need to clarify which country’s laws apply to the arrangements. That includes dividing your assets, alimony, childcare, parenting plan and pensions.

A legal puzzle
International family law is rarely straightforward. Treaties, EU regulations and national laws don’t always align seamlessly. This becomes especially tricky if you or your partner have dual nationality, live in more than one country, or have children attending school abroad. Which rules apply? Which country has jurisdiction? And which law governs your divorce?
International family law is one of Küppers & Odekerken’s key specialisms. With extensive experience in cross-border divorce cases, Linda Küppers is the right person to guide you. She knows which questions to ask, which treaties are relevant and how to protect your interests – legally and practically.
A step-by-step approach to international divorce
An international divorce requires tailored advice. That’s why it’s important to work with a lawyer who specialises in international family law. They know the pitfalls – and the solutions – and will ensure your interests are properly represented.
Step 1: Choose a specialised lawyer
An international divorce requires tailored advice. That’s why it’s important to work with a lawyer who specialises in international family law. They know the pitfalls – and the solutions – and will ensure your interests are properly represented.
Step 2: Is the Dutch court competent?
Not every international divorce can automatically be handled in the Netherlands. Jurisdiction depends on your nationality, residence and the place of marriage. We investigate whether the Dutch court can handle your case and which law applies. Thanks to our experience with international treaties and regulations, we quickly clarify your legal position.
Step 3: Do you need a foreign lawyer?
In some cases, it’s advisable – or even necessary – to bring in a lawyer from ‘the other country’. For instance, if (part of) the divorce falls under foreign law, or if the Dutch court does not have authority over all aspects of the case. If a foreign lawyer is needed, we coordinate the process and ensure smooth cooperation.
Our approach: clear, committed and experienced
Whether you live in the Netherlands with a foreign partner or are based abroad yourself, we support you every step of the way. So you know exactly where you stand – both now and in the future.
´I’m a lawyer who takes the reins - and together we define the strategy.´
